Previously Assets/Cash etc that was removed from the Asset pool was included as an “ADD BACK” on the balance sheet in property settlements. Now Sec 79 (3) Family Law Act 1975 requires the court to identify and adjust existing property and ADD BACKS are to be taken as part of a holistic weighing of contributions as was outlined inShinohara {2025} FedCFFamC1A 126. Where parents contribute to the asset pool (like providing a deposit for a home/paying stamp duty etc ) to determine the contributions of each party and how the court deals with parents’ contributions were outlined in Yeng & Sun {2025} FedCFam C1A 106. If your parents have made contributions to the asset pool it is important to contact Van Houten Law to discuss your matter.
